Question:
We had our home listed with an agent for 60 days During that time the agent had not brought anyone through. Our contract has since expired and we have listed our home for sale through Grapevine so that we can sell it ourselves. Three days after our contract had ended our former agent called and said that our listing with her was up,but that she had someone who wanted to see the house and could she show them. We told her she could go in and have yet to hear back from her on whether her client was interested or not. If her client comes back with an offer, are we responsible for a commission to this agent? We did not sign anything for her to show the house and our previous contract stated that if we sold the house to someone she had shown the house to sixty days after the end of contract date she owuld receive a commission, however she did not show the house to this person during our contract period. Hi Jen,
Thank you for contacting us. What you are referring to for the 60 days after the end of the contract is called the hold over clause. The holdover clause is there to protect the real estate agent in case a buyer who is introduced to your home during the listing tries to work out a deal in order to save commissions. In this case your sales representative had not introduced them to the home and therefore you would not be responsible for the commissions. However your sales representative may try to work out a commission with you if they are going to attempt to sell the home to this new person. It will be up to you to decide whether or not you want to let your sale representative still act on your behalf.
